Since 25 May 2018, the General Data Protection Regulation (DSGVO) has introduced new and uniform rules on the protection of personal data throughout the EU. As the DSGVO introduces partly new rules and legal concepts, there are still some uncertainties and unanswered questions that can only be clarified legally through jurisprudence and practice in the course of time. This includes, for example, the clear clarification of the question on which of the legal bases of the GDPR referred to in Article 6 may be based on which conventional data processing. For example, the precise distinction between the legal basis of the consent (Article 6 (1) (a) and the contract (Article 6 (1) (b)) and the scope of the so-called “legitimate interest” of the data processor (Article 6 (1) lit. f.) is still unclear.
Effective advocacy for digital citizen and consumer rights
At national and European level, there are a multitude of companies, security organizations and their associations promoting their one-sided interests. What has been missing so far is a strong user representation, which interferes with current legal processes, writes opinions from the user’s point of view and expresses these interests in hearings and in discussions with politicians.
